Jakarta, April 9, 2023

The Health Bill (RUU) provides additional legal protection for health workers. This is stated in the Problem Fill List (DIM) of the Bill which was submitted by the Government to the DPR RI on Wednesday (5/4).

Health workers, on the front line of health services, should have the right to good legal protection. In particular, health workers are the government’s strategic partner in achieving health transformation.

“Nakes is a strategic partner of the government in realizing the fundamental right of citizens to health. It is appropriate to obtain proper legal protection, said Ministry of Health spokesperson Dr. Syahril

In this bill, the government proposes to give additional substance to the right of students to benefit from legal protection, which is contained in Article 208E paragraph (1) letter a of the draft government proposal.

“Because of his status as an honors student, he is entitled to legal protection,” explained Dr. Syahril

The bill also contains provisions on the content of the right of medical personnel and health workers to stop services if they are subjected to physical and verbal abuse.

Apart from the new proposals, the rights of medical personnel and health workers that were previously listed in the current health law have not been lost. Especially with regard to the substance of legal protection when carrying out activities in accordance with the standards contained in Article 282, paragraph (1), letter a; Legal protection of medical personnel and health workers who provide services beyond their competence under certain conditions set out in Article 296; as well as giving priority to alternative means of resolving legal disputes concerning medical personnel and health workers, as stipulated in Article 322, paragraph (4).

In this bill, the government is instead proposing to remove the substance of the charges for medical workers/healthcare workers who have been subject to disciplinary hearings or alternative dispute resolution, which is contained in the section 328.

“We are proposing to remove this substance from the DIM, as it is a criminal and civil law substance,” explained Dr. Syahril
